How do I qualify for Traveller specific accommodation or Standard Local Authority Housing?

Traveller Specific Accommodation

It is the Council's policy to provide non-transient accommodation only for the County's indigenous Travelling Community. For this purpose the Council will only regard a Traveller household as "indigenous" where the household has been permanently resident in the County for at least three years. Therefore, if you have resided permanently for at least three years in this County.

Standard Local Authority Housing

Certain factors will be taken into account in order to assess your application ie, your household size, income, your present accommodation (if any), the condition of that accommodation and any special circumstances, including age, disability, medical circumstances, etc.


All applicants receive an initial interview upon receipt of their housing application form. The Housing Officer may visit you to assess your present housing circumstances.

The Traveller Accommodation Programme sets out all areas the Council is proposing for future Traveller Accommodation developments.

Who is Responsible for Moving Illegal Traveller Encampments?

In most situations; if a traveller family is illegally parked on public/private land or property, a statement must be made to the Gardai, and they can then arrange for the travellers to be moved under the Housing (Miscellaneous Provisions) Act 2002.

Public Roads are expressly stated to fall outside this legislation. Who is responsible for making the statement to the Gardai:

  • Clare County Council

    If a Traveller family illegally parks within 1 mile of an existing Traveller Complex then the Traveller Accommodation Unit will arrange for a Notice to be served under section 10(1) of the Housing (Miscellaneous Provisions) Act, 1992 as amended, requesting the family leave this location within 24/48 hrs. If they remain at this location after this time the matter will be considered for prosecution under relevant legislation.

    If a traveller family parks illegally on Clare County Council's housing land, the Director of Housing will arrange for a statement to be made to the Gardai.

    If a traveller family parks illegally on Clare County Council's industrial land, the Director of Planning & Economic Development will arrange for a statement to be made to the Gardai.

    If a traveller family parks illegally in carparks/open spaces within the function area of Area Offices/Town Council's, the statement will be made to the Gardai by one of the following Area Office/Town Councils:

    • Ennistymon Area Office
    • Shannon Area Office
    • Ennis Town Council
    • Kilrush Town Council
    • Kilkee Town Council
  • Private landowner/Property Owner

    If a traveller family parks illegally on private land/property it is the responsibility of the owner of that land/property to make the statement to the Gardai.
